Buying Spanish Property: an Explanation of the Legal Course of Action

Buying property in Spain is highly regulated. The best thing you can do to protect yourself and your money is to hire an English-speaking lawyer or legal counsel to help you during the purchase and negotiation. Validate that the Spanish property you plan to purchase is free of restrictive clauses and debts.
The legal process for purchasing property located in Spain falls under two types of transactions. The first legal document is the preliminary contract, known as Contrato privado de compraventa, and the second is the completion contract, known as Escritura de compraventa.
Once the buyer and seller are in agreement on the price then they need to sign a preliminary sales contract. The vendor needs to be able to provide proof that he or she owns the property, and that it is free of any charges, Before this Contrato privado de compraventa will be signed. Debts are charged to the property themselves in Spain, and any outstanding mortgage amount would then be passed on to the purchaser. Nota Simple tells about outstanding debts.
Details to be included in the draft sales contract will include the date of closure, agreed upon purchase price and a detailed accounting of the property being purchased. When you reach this point, you can expect to pay a deposit of 5-15%. These funds will be held for you in a bonded client account. It is possible though not advisable to sign the private preliminary sales contract without putting down a deposit.
Escritura de compraventa is otherwise known as the second or final contract stage. The purchaser will be required to pay the balance of the purchase price and all fees on the date of completion. Both the vendor and the buyer must sign the contract at the same time. This contract is equivalent to a deed on the purchased property. In front of a Notary Public the buyer will receive the deed of conveyance which is known as escritura in Spain. In order for everything to be legal a copy of the deed will have to go through the tax office and property registry. In Spain, all deeds of sale must be witnessed by a Notary Public, which is a public official in that country. However, you need to have your own legal counsel to protect your own interests during the transaction. Part of the fees for purchasing include property tax, and legal fees for your Notary Public.

Rotherham Council Absolved of Negligence in Sledging Accident
September 28, 2009, 6:22 amA tragic sledging accident involving a group of teenagers took place this winter in the first week of February. After a particularly heavy snowfall, these teenagers went on an expedition in the Rother Valley Park, during which one of them sustained fatal head injuries as she was thrown off a homemade sledge.
The 270-metre high grass slope that was not in regular use had been chosen by the group. Investigation revealed that the teenagers were using the roof of a Land Rover as their sledge. The roof’s weight and the height of the slope together caused the “sledge” to pick up speed. While coming down at a high speed, the teenagers hit a wire fencing and a young girl in the group named Francesca Anobile was thrown off. She died of serious head injuries, while her friends were severely injured.
Following this accident, the authorities of the park responsible for the safety of the visitors came under a cloud of suspicion regarding negligence, and an enquiry was conducted to investigate the same. The Rotherham Metropolitan Borough Council that managed the park were however not found to have any involvement in the accident.

Although not required, certification does offer a competitive advantage to those that have the credentials behind their name. It helps primarily when it comes to securing a job and for that reason and because a high percentage of paralegals coming into the field today are graduates from some either a community college or university; a good percentage of graduates are taking the time to pass one of the many readily available certification tests, shortly after graduation.
Intrinsic fundamental yardsticks to be aware of when assessing any paralegal degree program:
1. Paralegal degree courses must teach hands-on applicable job skills in addition to bottom-line legal theory. The curriculum should also emphasize legal writing, torts, legal contracts and research and legal ethics. Paralegal schools should advance a students’ discriminating thinking capacity along with communication, organizational skills and an aptitude to correctly handle ethical issues. ‘Fit Notes’ Concept Irks TUC

The problem of long term absenteeism may soon be much less severe, with the government deciding to scrap the sick note, which GPs have so far used to sign people off work, and introduce a fit notes in its place. However, the Trades Union Congress (TUC) has received the move with scepticism. Working immediately after an illness could slow down employees’ recovery and make them feel pushed back to work, believes General Secretary Brendan Barber.
A 12-week consultation has already begun on the new fit note. The note is aimed at providing expert medical advice to workers so that they don’t drift into long-term absence, and to employers regarding adjustments they can make to help staff return to work as soon as possible, taking into account their health condition. For example, suggesting desk jobs or in-house jobs for workers who find it difficult to move because of their illness.
According to Brendan Barber, a step-by-step return to work schedule, with proper support from the employer, seems a more appropriate option, which might include taking on limited duties or changes in the nature of work.
An early return despite poor health can prevent people from making a complete recovery, or even lead to deterioration of health. Moreover, lack of awareness on the part of the employer as to how he should make changes in the workplace to suit the needs of the ill employee could make matters worse.
There is also a risk that GPs may start acting as the employer’s advocate and workers may feel they are being pushed back to work. The most effective way of encouraging workers back to work is through providing access to proper occupational health support that will address all aspects of the workers’ health, Barber says.
